5th Circ. Pause Spells Doom for DOT Airline Fees Rule
Law360
Aviation attorney Anita Mosner was mentioned in a Law360 article about the U.S. Court of Appeals for the Fifth Circuit's decision to temporarily pause a new U.S. Department of Transportation (DOT) rule requiring airlines to more clearly disclose add-on fees upfront. The ruling is seen as a setback for the Biden Administration's efforts to expand consumer protections and could embolden opponents of more aggressive consumer-focused policies. Ms. Mosner noted that the ancillary fee rule was a "solution in search of a problem," as it mandated the disclosure of information that carriers already had to make publicly accessible. She added that the rule went beyond the scope of preventing "unfair or deceptive" practices both by specifying how information should be shared and requiring the information to be given to third parties.
