Sports Betting Ban, Carbon Credit Guides at Risk with CFTC Exits
Public Policy & Regulation attorney Alexander Holtan was quoted in a Bloomberg Law article about the potential impact of two Commodity Futures Trading Commission (CFTC) commissioners being nominated for positions at other agencies. The departure of Christy Goldsmith Romero and Kristin Johnson, both Democrats, could leave the CFTC shorthanded and hinder its ability to finalize rules on controversial topics such as election and sports betting and carbon-credit derivatives. Mr. Holtan noted that the loss of these commissioners would limit Chairman Rostin Behnam's opportunity to advance politically sensitive agenda items.
"To the extent that Chair Behnam wanted to do anything in the rest of this year that was potentially politically sensitive, it's off the table to the extent that Johnson and Goldsmith Romero would no longer be at the commission," he commented.
