Corporate Compliance Insights

Litigation attorney John Wood and labor and employment attorney David Santeusanio were mentioned in a Corporate Compliance Insights article about the top compliance stories of 2024 and expectations for 2025. The article covered major events such as Donald Trump's re-election, changes in federal agency power, artificial intelligence (AI) advancements and other regulatory developments. Mr. Wood discussed the Trump Administration's potential approach to federal regulations, while Mr. Santeusanio commented on the future of the Federal Trade Commission's (FTC) non-compete rule.

"The Trump Administration will likely have a deregulatory agenda. Thus, they are likely to revisit regulations that have been upheld under Chevron to assess whether those regulations would be upheld under the more stringent Loper Bright statute," Mr. Wood said.

"The successful legal challenges to the rule, the election of President Trump and a Republican-led Congress have placed the future of the rule in peril. If the FTC abandons the rule or the rule otherwise does not go into effect, then government regulation in the next four years on issues involving non-competes will likely be at the state level," Mr. Santeusanio remarked.
