Trump-Era Wage Rule Crafters Are Past Rule Challengers

Labor and Employment attorney Timothy Taylor was quoted in a Law360 article reviewing newly appointed U.S. Department of Labor (DOL) leaders' previous challenges to Democratic-era wage and hour rules and exploring what that could mean for upcoming regulatory actions. Drawing on his experience as former deputy solicitor of labor, Mr. Taylor explained how insider knowledge can shape agency rulemaking and litigation strategy, noting that such officials are uniquely positioned to press for repeal-and-replace approaches from within the DOL.

"Someone who has lived and breathed one of these pendulum-swing rules knows the particular strengths and weaknesses on the policy side and on the legal side, is typically familiar with the history of the rule, the internal department deliberations over it and the case law that matters," he said.
