Overview
Clay Falls is a litigation attorney in Holland & Knight's Dallas office who concentrates his practice on complex commercial litigation for clients across the country.
Mr. Falls represents clients ranging in size, from startups to Fortune 100 companies, in a broad range of cases as plaintiffs and defendants in both state and federal courts, as well as arbitration proceedings. He handles a variety of cases, including claims for breach of contract, breach of fiduciary duty, deceptive trade practices, unfair competition, misappropriation and theft of trade secrets, business fraud and negligence.
Mr. Falls also has substantial experience representing owners, developers, landlords and tenants in a wide array of real estate-related disputes, ranging from commercial lease evictions and lease defaults to construction disputes. In addition to real estate disputes, Mr. Falls actively manages the representation of real estate investment trusts (REITs) and other private investment firms in connection with their real estate acquisitions, dispositions and leasing needs across the country.
Additionally, Mr. Falls has experience defending personal injury tort claims, including claims for negligence, product liability and premises liability.
In addition to his litigation and commercial disputes experience, Mr. Falls serves as primary outside counsel to a number of emerging growth and middle-market companies, advising them on strategies for navigating potential legal risks in order to grow their businesses.
Prior to joining Holland & Knight, Mr. Falls worked for an international law firm and was a leader of its global commercial disputes practice group.
Representative Experience
- Managed representation of numerous private investment firms regarding the acquisition and disposition of industrial and retail properties across the U.S.
- Represented a large healthcare real estate investment trust (REIT) in a construction dispute involving tenant and third-party contractors and designers
- Represented the largest industrial warehousing REIT in the world (more than 1 billion square feet) in all aspects of landlord-tenant disputes, including suits for past-due rent and damages, evictions, tenant bankruptcies and disposition of abandoned property, in jurisdictions across the U.S.
- Represented a commercial real estate investment firm with various landlord-tenant disputes stemming from retail shopping center portfolios
- Served as outside litigation counsel to a large technology research, design and creation firm headquartered in Dallas
- Managed representation of a globally recognized brand of athletic apparel in various litigation matters in jurisdictions across the country
