Overview

T.J. McElhinney is an attorney in Holland & Knight's Litigation and Dispute Resolution Practice. Mr. McElhinney represents clients in complex, high-stakes commercial and business disputes involving contract- and tort-based claims, securities and investment disputes, and corporate governance and management disputes. Although based in Jacksonville, Florida, Mr. McElhinney's practice is national, and he represents clients across a broad range of industries, including financial services, real estate, construction, commercial and government contracting, and technology service providers.

Previously a civil engineer, Mr. McElhinney has an intimate understanding and appreciation for the construction and engineering industries. He has years of hands-on experience working at a top 10 national engineering design firm and a top 20 national contractor, as recognized by Engineering News-Record. Clients value his deep industry knowledge and appreciate the skilled advocacy he brings as an insider.

Some of Mr. McElhinney's recent successes include:

  • obtained a defense verdict in a jury trial on claims for business disparagement, defamation, intentional interference and civil conspiracy
  • obtained an early dismissal of $200 million New York Debtor and Creditor Law fraudulent conveyance claims allegedly arising from foreign investment
  • obtained an early dismissal of a $40 million Cayman Island claim for "fraudulent trading" in a precedent-setting decision
  • obtained an early dismissal of a class action seeking more than $20 million in damages against a government contractor employer
  • obtained a U.S. Court of Appeals for the Ninth Circuit judgment reversing a trial court's application of the federal officer removal statute in a precedent-setting opinion
  • successfully avoided an early termination of an energy infrastructure client's $20 million contract following a change in its ultimate beneficial owner during construction of classified government facilities that triggered Federal Acquisition Regulation (FAR) regulations on foreign ownership, control or influence (FOCI)
