Overview

David Rusk is a real estate attorney in Holland & Knight’s Houston office, where he focuses his practice on real estate and banking matters on a local, regional and national scale. He represents clients in negotiating purchase and sale agreements, leases (office, retail and industrial) and construction-related contracts. He also assists real estate developers with all aspects of the development process, with an emphasis on industrial projects, medical office buildings and other healthcare facilities and large residential communities.

Additionally, Mr. Rusk represents national and foreign lenders in a variety of lending transactions, including real estate and commercial and industrial loans. He has significant experience documenting complex construction, permanent and bridge loans. He also advises lenders in all aspects of the workout and foreclosure process.

Representative Experience

  • Represented a national bank in connection with a $425 million loan secured by 20 industrial, retail and office properties across five states
  • Represented a Houston-based developer in connection with a $130 million loan secured by a 13-property industrial portfolio
  • Represented a Houston-based developer in connection with the sale of a $95 million four-property industrial portfolio
  • Represented a multinational convenience store chain in its Texas and New Mexico acquisitions, dispositions and ground leases
  • Represented a landlord in the lease of office space in the Galleria area of Houston, involving 190,000 square feet and total rent of more than $52 million
  • Represents a Houston-based developer in the acquisition and development of business parks and rail storage facilities in Texas and Louisiana
  • Represents a national private bank in loans to high net worth individuals, including real estate, premium finance and yacht transactions
  • Represents a Texas bank in structuring and documenting middle market loans secured by real estate, accounts, inventory and marine vessels
  • Represents an S&P 500 real estate investment trust in the development of outpatient care clinics and related facilities
