Overview

Jody Schisel-Meslin is a commercial litigation attorney in Holland & Knight's Seattle office. Ms. Schisel-Meslin represents clients in a range of litigation matters across various industries, with a particular focus on the transportation and maritime industries. Her practice also includes general commercial litigation, arbitration and regulatory compliance.

Ms. Schisel-Meslin represents a diverse range of transportation clients – including shipowners, charterers, cargo interests, shippers and ocean carriers – in matters ranging from collisions and allisions, U.S. Coast Guard (USCG) and National Transportation Safety Board (NTSB) investigations, personal injury, shipowners' limitation of liability, pollution, cargo disputes and regulatory compliance.

Ms. Schisel-Meslin's practice also includes representing clients in complex commercial litigation in federal and state courts, as well as international arbitration forums. She assists clients through all phases of litigation, including initial investigation, pre-trial discovery, trial and appeals in matters involving breach of contract, energy disputes and insurance matters.

Prior to joining Holland & Knight, Ms. Schisel-Meslin worked as an attorney for an international law firm in its Seattle and Houston offices.

While in law school, Ms. Schisel-Meslin was a student attorney for the Tulane University Legal Assistance Program and served as the senior online editor for the Tulane Law Review.

Prior to attending law school, Ms. Schisel-Meslin managed a fleet of offshore research and multipurpose vessels operating out of the U.S. and Mexico, calling at domestic and international ports of call. She coordinated daily vessel operations and ensured vessel compliance with Class, Flag State and Port State regulations, in addition to managing U.S.- and Latin America-based crews.

Representative Experience

  • Litigated a shipowner's limitation of liability and Jones Act personal injury claims in a federal bench trial, achieving full exoneration and dismissal of all claims against the client
  • Achieved a summary judgment dismissal of salvage claims brought against a barge owner client, successfully litigating through the U.S. Court of Appeals for the Fifth Circuit, which ultimately affirmed dismissal
  • Negotiated a full voluntary dismissal of in personam and in rem claims in excess of $900,000 brought against a client vessel owner in a multi-party allision case
  • Negotiated a settlement for full monetary claim on behalf of a client dock owner in an allision case involving in personam and in rem claims
  • Represented a barge owner in a barge fleet breakaway resulting from Tropical Storm Imelda, overseeing U.S. Coast Guard (USCG) and National Transportation Safety Board (NTSB) investigations, and ultimately recovering the damages associated with the loss and/or repair of the barges when they broke free from the fleet
  • Advised vessel owners regarding allegations of violations of the International Convention for the Prevention of Pollution from Ships (MARPOL) and Act to Prevent Pollution from Ships (APPS), including initial incident investigation, voluntary disclosures, and criminal and civil penalty process

  • Represented an industrial subcontractor through trial, obtaining a favorable jury verdict in a breach of contract and contractual indemnity case
  • Defended a major oilfield subcontractor in a personal injury and wrongful death case involving multiple defendants, securing full dismissal for client
  • Achieved a favorable settlement for an industrial services provider in a products liability action involving an underwater pipeline

  • Represented an ocean carrier in arbitration before the Society of Maritime Arbitrators relating to a shipper's breach of ocean carrier agreements
  • Represented a vessel owner in a detention and demurrage dispute in an international arbitration proceeding
  • Represented a charterer in a charter party dispute involving multiple vessel interests and cargo interests in an international arbitration
