Jesse Vogtle is an attorney in Holland & Knight's Birmingham office. Mr. Vogtle focuses his practice on a variety of bankruptcy matters.

Mr. Vogtle has delivered comprehensive and efficient solutions to major case participants in complex commercial Chapter 11 bankruptcy cases for more than 37 years. His practice has expanded to a national platform representing financial, healthcare, restaurant franchises, energy companies, debtors and creditors in both in-court and out-of-court insolvency and workout proceedings.

Representative Matters

  • Represented secured lenders in the Montgomery Transportation logistics failure by successfully achieving appointment of a federal receiver in 2025 to recover thousands of rolling stock and other assets abandoned throughout North America and to pursue claims maximizing collateral liquidation and recovery
  • Represented a franchisor/franchisee in the refinancing of a multistate fast food pizza business as well as closure of certain underperforming restaurants in Texas
  • Represented a franchisee in the restructuring/recapitalization of a syndicated loan secured by 174 quick service restaurants (QSRs) operating across multiple Southeastern states
  • Represented an existing franchisee in a successful Chapter 11 stalking horse bid to purchase 32 Burger King restaurants in South Florida
  • Represented a franchisee in a negotiated forbearance, refinance and closure of certain restaurants located in Georgia
  • Represented a Burger King franchisee as a stalking horse bidder for 19 QSRs in a Chapter 11 bankruptcy filed in Tallahassee, Florida
  • Represented a Popeye's franchisee in a restructure of its secured debt, securing 136 QSRs located in Florida and Georgia
  • Represented Premier Kings Inc., a 172-unit franchisee of Burger King Corp., in a Chapter 11 case filed in the U.S. District Court for Northern District of Alabama, Southern Division, resulting in four separate sale transactions to Mosaic Gold Crown Group, Bulldog Restaurants, RRG of Jacksonville and Burger King Company; the transactions were recognized as the 2024 Chapter 11 Restructuring of the Year at the 16th Annual Turnaround Atlas Awards ceremony
  • Represented a lender in a $24 million loan restructure involving a vertically integrated fishing and fish processing operation in Jacksonville, Florida
  • Represented a franchisee with 30 QSRs in Alabama and Tennessee, as the debtor in Chapter 11 proceedings involving a 363 sale via a stalking horse bidding process
  • Served as counsel to bondholders' representative facilitating deed in lieu agreement on a $7 million bond issue secured by a senior living facility in Anniston, Alabama
  • Served as counsel to bondholders' representative in litigation against the principals of an assisted living facility in Sarasota, Florida, with a defaulted $38 million bond indenture
  • Served as counsel to bondholders' representative facilitating the appointment of a federal receiver to finish construction of $42 million defaulted bond issue for a Florida senior assisted living facility
  • Represented a bank as bond trustee holding a security interest in all of the assets of a bankrupt biomass manufacturer and facilitated the sale of those assets
  • Served as lead Chapter 11 bankruptcy counsel to an Alabama-based coal mining company and five of its affiliates, resulting in a confirmed plan of reorganization
  • Represented a research foundation in the bankruptcy negotiation and assignment of a medical instrument license to a solvent manufacturer
