Litigation Partner Dan Small will participate on the American Bar Association Criminal Justice Section, Health Law Section and the Center for Professional Development's Webinar titled "The Affordable Care Act and Health Care Fraud: The Beat Goes On."

This webinar is designed to focus on the ACA provisions having the most significant impact in the fraud and abuse enforcement and compliance areas.  The topics that will be addressed during the webinar include the increased funding and expansion of Federal and state enforcement efforts and the significant amendments to the False Claims Act. 

Mr. Small will also discuss the ramifications of the “lowered intent” standard applicable for criminal liability under the Federal Anti-Kickback Statute and the establishment of the Centers for Medicare and Medicaid Services Self-Referral Disclosure Protocol (“SRDP”) facilitating self-reporting of violations of the Federal Stark Law.  He will also address the mandatory compliance programs for healthcare organizations and, finally, a discussion of the amendments to the False Claims Act and Civil Money Penalty Law establishing the basis for liability for failure to return a known overpayment within 60 days of identification of the overpayment.
