Session 1: Decoding Cyber Risk for Law Firms

Cybersecurity remains a significant source of stress and risk for law firms while continuing to be an enigma to risk managers and in-house counsel who are managing associated risk. This panel will examine some common (and some new) cyber risks that lawyers and law firms face, best practices and practical solutions for managing that risk, and industrywide trends of which firms should be aware. For those new to the law firm risk manager role, the panel will also explain some cybersecurity basics.

Session 2: Conflicts' Greatest Hits (and Misses) 2020-2021

While most of us have spent the majority of our time working from home, the conflicts of interest world has continued to move in multiple and not necessarily consistent or predictable directions. This session will provide an overview of evolving or recent conflicts-related developments, including the latest word(s) on effective conflicts waiver letters, conflicts resulting from representing past or present employees at deposition, fee disgorgement claims and their limits, and motions to disqualify.

Session 3: The Brave New World: Emerging Issues in the Practice of Law

Effective risk management is about understanding the current business and legal landscape, and anticipating changes on the horizon. This panel will discuss emerging trends in the regulation of our profession and ways that we lawyer on a day-to-day basis. Topics include where the regulation of multijurisdictional practice is headed, the tax implications of having remote lawyers in other states and three things every lawyer should know about alternative business structures, including the emerging world of non-lawyer ownership of law firms.

Session 4: Lawyer as Employer: The Case for In-House Counsel and Risk Management

Once primarily a bastion of BigLaw, the law firm in-house counsel and risk manager role has increasingly become a necessary and visible feature across law firms of all sizes. With responsibilities ranging widely from contract negotiation and conflicts approval to cyber risk management, drafting employee handbooks and much more, the role has the potential to touch nearly every aspect of a law firm's operations. Although many firms rotate general counsel duties from year to year among the firm's partners while they also work to maintain their own full-time practices, more and more firms are recognizing the need for consistent, full-time general counsel to fulfill its in-house needs. This panel will discuss trends and best practices for the in-house law firm counsel and risk manager, including job duties and expectations, pay practices, privilege issues and when it may be best to look to outside counsel for the firm's needs.
