New York Sues Trump Over Ban on Global Access Program

Immigration Partner Leon Fresco joined a Bloomberg Law podcast to discuss New York's lawsuit against the Trump Administration for blocking New York State residents from participating in pre-screening programs that help travelers move quickly through U.S. airports and borders. The Administration claims that the state's refusal to share driver's license information with the federal government makes it difficult for the government to determine who is a trusted traveler for the purposes of these pre-screening programs and thus creates an increased risk that justifies banning New York residents from participating in them. The lawsuit counters that the ban violates the 2004 Intelligence Reform and Terrorism Prevention Act that created the program by discriminating against a single state as well as offers Constitutional grounds for disputing the ban's validity.
