Bill Seeks to Repeal PND Territorial Determinants
Mining attorney Estefanny Pardo presented a radio program in partnership with La Voz Minera EMG titled "Minería al Día con Estefanny Pardo." In this episode, Ms. Pardo examines the bill filed on October 21 that proposes repealing Article 32 of Law 2294 of 2023 (PND 2022-2026), which introduced a rigid hierarchy of "determinants" for land use planning. She argues that this prioritization, ranging from environment and climate change to food sovereignty, heritage, infrastructure and tourism, strips powers from territorial entities, restricts private initiative and freedom of enterprise, and creates legal uncertainty by imposing broad, ill-defined criteria without decision-making participation by local authorities. Ms. Pardo also describes the implications for land use and productive projects (including in the mining and energy sectors) and expresses that it is important to restore municipal autonomy through the proposed repeal.
