Mining Bill: What Is the Legislative Process?
Mining attorney Estefanny Pardo presented a radio program in partnership with La Voz Minera EMG titled "Minería al Día con Estefanny Pardo." In this episode, Ms. Pardo examines Colombia's recently introduced mining bill, focusing in particular on the uncertainty over whether it should be treated as a statutory law or an ordinary law and the implications this has for its legislative process, approval timelines and potential review by the Constitutional Court. She observes that the bill could fundamentally transform Colombia's mining contracting model by concentrating activity with the state and restricting private initiatives, as well as raises concerns about the effectiveness of state-run mining without sufficient technical capacity. Ms. Pardo also advised stakeholders to monitor the bill's progress in the legislature and predicted constitutional challenges if the final product does not comply with the requirements for a true statutory law.
