Recent Agency Opinion on Safety in Underground Mining Operations

Mining attorney Estefanny Pardo presented the radio program in partnership with La Voz Minera EMG titled "Minería al Día con Estefanny Pardo." In this episode, Ms. Pardo discusses a recent legal opinion from Colombia's National Mining Agency (ANM) on mining accidents and workplace safety, noting that many of the ANM's largest fines stem from safety and hygiene violations. She highlights that, under Colombia's Mining Code, mining activities are carried out at the titleholder's risk and the concessionaire must comply with applicable technical and operational safety duties. Ms. Pardo then explains how Article 8 of Decree 1886 of 2015 should be read when third parties operate or execute mining works: Hiring an operator does not transfer the titleholder's obligations before the ANM. Instead, contractors must commit contractually to comply with the safety rules, while the mining titleholder remains accountable to the authority for incidents and non-compliance unless a formal, authorized transfer of rights occurs.
