Illinois Considers Legislation to Unwind Applied Behavior Analysis Restrictions

Healthcare Transactions attorney John Saran was featured on an episode of the American Health Law Association's (AHLA) Speaking of Health Law podcast, where he talked about proposed Illinois legislation affecting applied behavioral analysis (ABA) businesses. Current state law requires Board Certified Behavior Analysts (BCBAs) operating in Illinois to become licensed and stipulates that ABA businesses owners must also obtain a license by January 1, 2027. Senate Bill (SB) 3807 and House Bill (HB) 5171 propose to remove the licensing obligation for ABA business owners as well as create pathways for BCBAs to form professional corporations or limited liability companies (LLCs). During the episode, Mr. Saran, together with an ABA practice founder and licensed behavioral analyst, explored how SB 3807 and HB 5171 would affect organizations and individual practitioners in addition to how the industry overall is adapting to updated licensing regimes.
