All's Fair ... Political Advertisements, Defamation and the First Amendment

Media Law Associate Christine Walz authored an article for the Media, Privacy and Defamation Law Committee Newsletter titled "All's Fair … Political Advertisements, Defamation and the First Amendment."

In 2010, in Citizens United v. Federal Election Commission, the U.S. Supreme Court noted that government restrictions on speech close to an election are suspect because that is the time when political speech is most influential. In the article, Ms. Walz discusses a number of lawsuits that were filed in 2010 attempting to either prohibit candidates from airing advertisements or seeking damages for allegedly false and harmful advertisements.
