D.C. Circuit Blocks NLRB Posting Rule

As you may remember, the National Labor Relations Board (NLRB) issued a controversial rule in August 2011 requiring most U.S. employers to post a workplace notice informing employees of their rights under the National Labor Relations Act. A three-judge panel of the D.C. Circuit Court of Appeals decided last week that the posting rule violated § 8(c) of the Act, which protects speech that isn’t threatening or doesn’t promise benefits.
