CDC Cannot Halt Evictions as a Public Health Measure
Litigation Partner Steven Gordon published in article in Law360 analyzing federal court rulings on the eviction moratorium ordered by the Centers for Disease Control and Prevention (CDC). In late 2020, two courts upheld the moratorium, rejecting arguments that the order exceeded the CDC's authority. However, two recent rulings from other courts held the opposite. Mr. Gordon's article analyzes the asserted authority for the moratorium and discusses why, under well-established principles, it exceeds the authority Congress has delegated to the CDC.
