Can Steve Bannon Raise an Advice-of-Counsel Defense?
Litigation attorney Steven Gordon authored an article for Bloomberg Law analyzing former Trump adviser Steve Bannon's contempt of Congress case. Steve Bannon claims he is not guilty of contempt of Congress for refusing to testify before the House Jan. 6 committee because he was following the advice of counsel. The government asserts that Steve Bannon cannot raise an advice-of-counsel defense to his criminal contempt charges for refusing to comply with a congressional subpoena regarding the Jan. 6 attack on the U.S. Capitol. In this article, Mr. Gordon explains why Bannon should at least be allowed to raise an advice-of-counsel defense.
