The Imperative to Update Article 185 of the Commercial Code: Reflections in Light of Decree 046 of 2024
Corporate attorney Daniel Fajardo wrote an article for Lexir in which he details the implications of new legislation that addresses conflicts of interest in Colombian companies. Decree 046 of 2024 expands the definition of conflicts of interest and disloyal competitive acts, among other matters, creating urgency to update other laws, such as Article 185 of the country's Commerical Code, that no longer respond effectively to modern corporate structures.
