Playing the MDL Game
Litigation attorney Eric Alexander authored an article featured by Drug & Device Law discussing the complexities of product liability multidistrict litigations (MDL), highlighting that more than 99 percent of MDL cases end in dismissal. The article examines the In re Cook Med., Inc. case, where lawsuits were dismissed because of a lack of diversity jurisdiction, and the court's controversial decision not to sanction the plaintiffs' attorneys under Federal Rule of Civil Procedure 11 for filing in the wrong court.
