U.S. Supreme Court Takes Up Nuclear Waste Storage Cases

Pratt's Energy Law Report
Andy Kriha

Public Policy & Regulation attorney Andy Kriha wrote an article included in Pratt's Energy Law Report about the U.S. Supreme Court's decision to review cases concerning the Nuclear Regulatory Commission's (NRC) authority to license temporary nuclear waste storage facilities. The cases, which originate from a ruling by the U.S. Court of Appeals for the Fifth Circuit, challenge the NRC's licensing authority and reflect diverging court opinions. Mr. Kriha examines the potential implications for the NRC's authority and the wider nuclear industry, focusing on the balance between existing governmental mandates and the challenges of long-term nuclear waste storage. The Supreme Court's decision has the potential to redefine the scope of agency authority and judicial review under the Hobbs Act.

Mr. Kriha also published a Holland & Knight alert and was featured in an "Energized Exchange" podcast episode on this topic.
