A Look at Ongoing Nuclear Litigation
Energy attorneys Andy Kriha, Elizabeth Craddock and Elizabeth Perry co-authored an article published in Pratt's Energy Law Report reviewing notable updates in nuclear energy-related litigation. The authors begin by analyzing State of Texas, et al. v. U.S. Nuclear Regulatory Commission, in which Texas, Utah and a private microreactor manufacturer are challenging the U.S. Nuclear Regulatory Commission's (NRC) authority to require construction and operating licenses for small reactors. The NRC filed a motion to dismiss the case on procedural grounds, hoping to do away with it before a court can hear its merits. The article then covers Mazzocchio v. Cotter Corp., which concerns standard of care for injuries caused by exposure to radioactive material.
