Fact Check: Ted Cruz, Greg Abbott Promote Claim That Texas Would Lose Powers in Border Deal
Immigration attorney Leon Fresco was quoted in an article published by the San Antonio Express-News addressing claims that a proposed Senate border bill would limit Texas' ability to legally challenge immigration policies. The article counters arguments that restricting certain lawsuits to D.C. courts would strip Texas of key powers. Mr. Fresco explained that this provision aligns with existing law and clarified that the bill would not change how Texas can sue over immigration issues or what it can challenge in court.
"It's not new or old. It's just a consistent continuation of what the current law is," he said. "The only difference is, this new thing that didn't exist yesterday, if it existed today, they would have to sue in D.C. Nothing is taken away from what they can sue about today."
