Tampa Attorneys Weigh in on Non-Compete Ban: It's 'Taking a Sledgehammer to the Issue'

Labor and employment attorney David Lisko was mentioned in a Tampa Bay Business Journal article about the Federal Trade Commission's recent ban on non-compete agreements. The article examined the potential impacts of the ban on employers' ability to protect trade secrets and confidential information. Mr. Lisko noted that while businesses can no longer rely on non-compete agreements, they can still utilize various federal and state laws to safeguard sensitive and valuable information. These include claims for breach of duty of loyalty, tortious interference, unjust enrichment, computer fraud and abuse, violations of non-solicit agreements, misappropriation of trade secrets and deceptive and unfair practices.

Mr. Lisko cautioned that companies will need to dig deeper to enforce legal protections, saying: "It will take business owners more vigilance to protect themselves. Non-competes were easier and simpler to enforce because they're less fact intensive."
