CFIUS Report Says More on Real Estate Than Meets the Eye

International Trade attorney Robert Friedman was featured in a Law360 article discussing a report submitted to Congress by the Committee on Foreign Investment in the United States (CFIUS) that highlighted no significant changes to real estate-related cases reviewed in 2023 compared to the previous year, indicating ongoing attention to property transactions. The report highlighted that CFIUS examined undeveloped land deals near sensitive military sites involving foreign entities, with a slight decrease in filings from 2022. Mr. Friedman shared this sentiment and explained that the report did not elaborate on the considerations made during the reviews of real estate transactions falling under CFIUS Part 800 and Part 802 jurisdiction. As a result, he emphasized the need for cautious interpretation of the report findings.

"I don't think we're seeing in the actual, raw numbers that come out in the report a material impact or material change with regard to real estate. But I think we need to take that with a grain of salt," he said.
