5 Wage Issues Trump's Labor Secretary Will Inherit
Labor and employment attorney Timothy Taylor was interviewed by Law360 for an article discussing five issues the incoming U.S. Department of Labor Secretary (DOL) will face once President-Elect Donald Trump takes office. If confirmed, Trump's nominee Rep. Lori Chavez-DeRemer (R-Ore.) will have to contend with matters including ongoing litigation over wage and hour rules such as the federal contractor minimum wage, overtime regulations and child labor laws. Mr. Taylor commented on initiatives offering compliance assistance for employees, such as the Payroll Audit Independent Determination (PAID) program that arose during the first Trump Administration. Under the PAID program, employers could self-audit and self-report wage violations to mitigate the risk of litigation and penalties. Although the Biden Administration ended the program, Mr. Taylor explained it could resurface under the new DOL.
"It was a sensible way to find violations that might well have not been found, but in a way that allows employers to true-up their workers in a proper manner that limits their liability," he said.
