Biden Prevailed on Wage Policies, But Trump Can Undo Them

Labor and employment attorney Timothy Taylor was quoted in a Law360 article discussing President Joe Biden's efforts regarding independent contractors and prevailing wages, along with how the incoming administration will address minimum wages. Although Biden advanced his pro-worker agenda through executive orders, such as establishing a $15 hourly wage for federal employees and contractors, his major legislative goals, such as raising the general federal minimum wage, did not advance in Congress. In addition, under Biden the U.S. Department of Labor (DOJ) issued a rule raising the salary threshold for overtime exemptions under the Fair Labor Standards Act (FLSA), but a federal court struck it down. Mr. Taylor outlined two potential paths for handling overtime rules.

"One would be to just quietly let the Biden rule die and go ahead with the last Trump rule. Or they could do something similar to what they did in 2019, which is a repeal-and-replace strategy," he said.
