If You Present False Documents to Withdraw Severance Pay, You Can Be Fired

Labor attorney Camilo Cuervo was interviewed by Asuntos Legales about the consequences of using false documents to withdraw severance pay. Mr. Cuervo warned that although employers can initiate an internal disciplinary process in response to such findings, determining a crime such as document falsification is exclusively the jurisdiction of a criminal judge.

“It is essential to be especially careful with the terms and handling of the situation because employers are not authorized to determine that an employee has committed a crime, and in that sense, alleging document falsification is a conclusion that only a criminal judge could make,” he said.
