Trump Administration Poised to Let Shippers File Class Action Complaints Against Container Lines

Transportation and Infrastructure Group Co-Chair Christopher Nolan was quoted in a Trade Winds article discussing the Federal Maritime Commission's (FMC) new policy guidance on class action complaints against container liner operators. In the guidance, the FMC clarified it is an appropriate venue for class action litigation concerning disputes that fall under its jurisdiction, such as those pertaining to the Shipping Act. However, Mr. Nolan expressed concerns about the feasibility of meeting these demands within the FMC's tight procedural timelines.
"The FMC is already a super rocket docket. In a class action, that's impossible," he said.
