Insurers' Win In Arbitration Treaty Ruling Narrows Circuit Split

Litigation attorney Brian Briz was quoted in a Law360 article discussing the significance of a recent Second Circuit ruling that favors international insurers’ ability to arbitrate insurance disputes in the U.S. Mr. Briz noted that the alignment among federal appellate courts on interpreting the New York Convention and the McCarran-Ferguson Act provides added clarity for insurers and makes Supreme Court review of the issue less likely. He emphasized that this growing judicial consensus will benefit foreign insurers by reducing uncertainty and litigation risk when enforcing arbitration agreements in states with anti-arbitration laws.

"Any time you see courts aligning on their reasoning and on their outcomes, I think it's a good thing — it adds more clarity for everyone," he said.
