Lawsuits or Annulment Actions Are Options for Companies in Response to the Government's Request

Energy & Natural Resources attorney Milton Montoya was mentioned in an article published by Portafolio about the legal options available to natural gas public service providers in response to the national government's request to adjust natural gas tariffs. The article highlighted that, in addition to reconsideration requests, companies could file lawsuits or annulment actions in the administrative disputes court if their requests are denied, although it warns that if these actions do not succeed, companies will have to comply with the requests to avoid sanctions. On the other hand, Mr. Montoya pointed out that if these actions are successful, the only alternative for the government would be a structural reform to the public utilities law.
"Traditionally, the mechanism companies have used to face the government's decisions on tariffs involves reconsideration requests before the CREG itself; however, there are other actions – annulment actions have also been filed before the administrative disputes court, whether against decrees or resolutions," he said.
