Pension Reform Continues to be Held Up in the Constitutional Court by Recusals

Labor and Employment attorney Camilo Cuervo was quoted in La República on the Constitutional Court's review of Colombia's pension reform, which faces challenges over alleged procedural defects highlighted by Magistrate Jorge Enrique Ibáñez. Though Colpensiones argues Congress cured any defects during extraordinary sessions, sector leaders warn delays are costing the public system billions and prolonging uncertainty. Mr. Cuervo called the measure "flawed" from the outset and predicted the court will strike it down on procedural grounds, noting that a decision is expected by the end of October.

"If the court decided to say that there were no procedural defects, it would have to review the substantive defects, in which the rule is also weak, because there are errors in its formulation," he said.
