Can You Record a Boss Who Commits Workplace Harassment Without Their Consent?

Labor and Employment attorney Camilo Cuervo was interviewed by Asuntos Legales about the admissibility of audio or video recordings without the alleged aggressor's consent as evidence of workplace harassment. The article explained that, according to the Constitutional Court, when the employee is directly involved and the recording is made within the workplace, such evidence can be fully valid, provided it respects privacy and is obtained legally. In contrast, recordings made in personal spaces, such as bathrooms or residences, could be illegal and inadmissible. Mr. Cuervo emphasized the requirements of the principles of legality and contradiction, as well as the importance of supplementing recordings with other evidence.
