High Court Ruling May Speed Future Policy Pivots at EEOC

The article explored how the case outcome could reshape the relationship between the White House and the agencies charged with enforcing workplace laws, including the EEOC, National Labor Relations Board (NLRB) and U.S. Department of Labor (DOL). Mr. Taylor told Law360 the decision may lead to greater alignment among federal labor and employment agencies and create opportunities for enhanced coordination on shared policy and enforcement priorities.

"If anything, I think the Slaughter decision will surprisingly make that kind of cooperation easier, because you'll have aligned appointees across all those agencies and an understanding that they have their policy priorities being centralized and coordinated through the White House," he said. "So I think Slaughter may assist DOL and the EEOC and the NLRB with joint initiatives, joint enforcement networks and so on, because they're now all essentially operating under the same set of rules."
