Kalshi Is Launching Prediction Apps with Native American Tribes. That's Dividing Indian Country.
Native American Law Team Leader James Meggesto was quoted in a CNN article about new partnerships between the prediction market platform Kalshi and Native American Tribes. This week, four Tribes launched prediction apps with Kalshi, adding to a growing number of groups exploring prediction markets as a new revenue stream instead of opposing their operation like much of the rest of Indian Country. Kalshi and Polymarket currently face dozens of lawsuits from state governments and Tribal leaders and advocates, who argue sports event contracts are not federally regulated financial exchanges and instead fall under the purview of state gaming laws and the Indian Gaming Regulatory Act. With split decisions among courts, most believe the U.S. Supreme Court will ultimately decide the issue. James shared his observations on the litigation thus far.
"It was reactionary at the start. The gaming Tribes were tuned in early on," he recounted. "But the last year has seen a real galvanization of the opposition, notwithstanding a handful of Tribes that are dipping their toes into it."
