Overview
Danny Athenour is an attorney in Holland & Knight's Denver office and a member of the Litigation and Dispute Resolution Practice. Mr. Athenour focuses his practice on a variety of litigation matters.
Mr. Athenour is experienced in intellectual property (IP) disputes involving patent, trademark and copyright infringement, including litigating patents in semiconductor and telecommunication technologies. He also has a significant background with contracts, business torts and trade secrets.
Prior to rejoining Holland & Knight, Mr. Athenour worked for a national law firm. He previously clerked for the Honorable Jane J. Boyle of the U.S. District Court for the Northern District of Texas, where he helped manage and provide draft opinions on the court's most complex cases, including patent litigations and other IP disputes, as well as bankruptcy appeals, class actions and securities cases.
In the community, Mr. Athenour has a passion for helping those with disabilities. In 2018, he completed the Trans-America Route of the Journey of Hope, cycling 4,370 miles over 10 weeks to raise funds and awareness for people with disabilities.
Representative Experience
- Defended a large semiconductor technology company against claims for infringing multiple patents allegedly covering various wired- and wireless-telecommunications standards
- Defended a multimillion-dollar cattle ranch against trademark infringement claims over the ranch's brand and name
- Assisted in pre-suit discussions and negotiations with a patent owner over allegations of patent infringement against a luxury nightclub, avoiding the threatened lawsuit
- Assisted the trial team in defense of trademark infringement claims against a national ice cream manufacturer and distributor
- Obtained a multimillion-dollar judgment against a trademark counterfeiter for selling expired and defective products on a global e-commerce website
- Represented former business owners in a suit over breach of contract and fraud relating to the sale of their insurance business; obtained a multimillion-dollar settlement following mediation
- Lead counsel in an arbitration hearing, representing a credit union against multimillion-dollar claims under the Fair Credit Reporting Act (FCRA)
- Represented a foreign company providing cryptocurrency-related services to users; achieved dismissal of all claims and avoided a putative class action
- Defended a high-profile client in claims of breach of contract, fraud and conspiracy relating to the sale of a luxury car
