Overview

Hannah Berny is an attorney in Holland & Knight's Nashville office. As a member of the firm's Bankruptcy, Restructuring and Creditors' Right's Practice Group, she focuses her practice in helping corporate debtors, secured and unsecured creditors, and court-appointed trustees in complex corporate restructurings and liquidations in Chapter 11, Chapter 9 and Chapter 7 cases.

In addition, Ms. Berny represents plaintiffs and defendants in complex commercial litigation in federal and state court. Ms. Berny's practice also includes representation in out-of-court restructurings and solutions, including Uniform Commercial Code (UCC) Article 9 foreclosures, real estate foreclosures and creative refinancings. Ms. Berny's clients include hospitals and health systems, banks and financial institutions, dental groups, real estate groups and professional sports organizations, among others.

Prior to joining Holland & Knight, Ms. Berny worked as a judicial clerk for the 21st Judicial District of the Williamson County Circuit Court in Tennessee, and for the Honorable W. Neal McBrayer of the Tennessee Court of Appeals.

Representative Experience

  • Representation of Huntsville Memorial Hospital in its Chapter 11 case in the U.S. Bankruptcy Court for the Southern District of Texas, running point on all underlying associated adversary proceedings
  • Representation of court-appointed Chapter 11 trustee in a highly contested individual Chapter 11 bankruptcy out of Texas involving multistate land disputes and corporate governance issues
  • Representation as co-debtors' counsel of MTPC LLC, The Proton Therapy Center LLC and PCPT Hamlin LLC, providers of proton cancer therapy, in their jointly administered Chapter 11 bankruptcy cases in the U.S. District Court for the Middle District of Tennessee; all three debtors confirmed plans of reorganization
  • Representation of Pinecrest Pigeon Forge HOA Inc. in its Chapter 11 case in the U.S. Bankruptcy Court for the Middle District of Tennessee, obtaining the successful sale of a timeshare property and confirmation of an associated plan of liquidation
  • Representation of Promise Healthcare Group and its affiliates and the post-confirmation liquidating trust in their Chapter 11 cases in the U.S. Bankruptcy Court for the District of Delaware
  • Representation of HCA Healthcare in its acquisition of Trinity Regional Hospital located in Plano, Texas, out of the hospital's Chapter 11 case in the U.S. Bankruptcy Court for the Northern District of Texas
  • Representation of the indenture trustee in the City of Chester, Pennsylvania, Chapter 9 bankruptcy case
  • Representation of an energy management conglomerate in a highly contested dispute related to the lifting of the automatic stay before the U.S. Bankruptcy Court for the Southern District of Texas
  • Representation of collateral trustee in financing facilities extended to a Fortune 500 integrated retail electricity and power generation company
  • Representation of the secured party in the Uniform Commercial Code (UCC) foreclosure sale of equity interests serving as collateral of a mezzanine loan facility, including a successful credit bid, acquisition and restructuring
