Overview
Siobhan K. Cole is a litigation attorney in Holland & Knight's Philadelphia office. Ms. Cole represents individuals and commercial clients in a variety of complex areas arising from business disputes.
Ms. Cole handles complex commercial cases across numerous areas of law, including unfair competition under state and federal law, professional liability, indemnification and all manner of business torts and contract disputes. She also handles defense of consumer class actions, including matters related to food labeling and advertising, the Fair Debt Collection Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA) and Pennsylvania Minimum Wage Act.
Ms. Cole has experience arbitrating cases and litigating commercial matters in state and federal courts in Pennsylvania and New Jersey, and she has been a member of multiple trial teams in state and federal courts in New Jersey, Pennsylvania and Delaware. She also has extensive experience in the state and federal appellate courts, including the New York Supreme Court, Appellate Division, First Department; Superior Court of New Jersey, Appellate Division; Superior Court of Pennsylvania; U.S. Court of Appeals for the Third Circuit; U.S. Court of Appeals for the District of Columbia Circuit; and the U.S. Supreme Court.
Ms. Cole previously served as a mediator in the Philadelphia Court System and uses the creative persuasion and problem-solving skills she gained in that position to effectively negotiate with parties and counsel on behalf of clients. One of her particular strengths is her ability to recognize and understand the legal and factual issues of her cases, as well as the personal and commercial motivations of her clients and opposing parties, which she uses to advocate for her clients and negotiate on their behalf.
In addition to her legal practice, Ms. Cole is a dedicated volunteer for the Homeless Advocacy Project (HAP) and counts her experience representing its clients among the most rewarding of her career.
Representative Experience
- Pursued, argued and prevailed in a landmark appeal to the U.S. Court of Appeals for the District of Columbia Circuit, en banc, overcoming 50 years of circuit precedent regarding the Federal Energy Regulatory Commission's (FERC) review process for Certificates of Public Convenience and Necessity under the Natural Gas Act; the case was featured by Bloomberg Law as one of the most important cases affecting the energy sector in 2020
- Won a full defense verdict as lead trial counsel in a Lanham Act unfair competition case after a month-long jury trial in the U.S. District Court for District of New Jersey, with exposure and claimed damages in excess of $20 million
- Aided representation of a large family-owned corporation through a complex and public struggle for control of the company, including a 15-day trial in the Delaware Court of Chancery
- Prevailed in defense of a company's former president and CEO against claims for breach of fiduciary duty and alleged damages in excess of $40 million, including a lengthy trial and appeal process in the U.S. Bankruptcy Court for the District of Delaware and U.S. Court of Appeals for the Third Circuit
- Represented Pennsylvania homeowners against the improper taking of their property for private benefit, including evidentiary hearings in the U.S. District Court for the Eastern District of Pennsylvania, appeals to the Third Circuit and D.C. Circuit, as well as the U.S. Supreme Court and oral argument before the D.C. Circuit
- Defended against a multimillion-dollar damages claim for alleged breach of a right of first refusal in connection with a private investment in a public equity transaction
