Overview

Anna Day is a trial attorney in Holland & Knight's Denver office. Ms. Day represents clients in commercial litigation at the trial and appellate levels. She has significant experience counseling clients in a range of industries, including financial services, labor and employment, insurance and construction. Ms. Day has jury trial experience and has first-chaired many cases throughout the course of her career.

Ms. Day's recent litigation and class action experience includes:

  • representing a client in a four-day jury trial involving claims of fraudulent transfer and successor liability of the acquiring company
  • handling multimillion dollar commercial disputes, including complex breach of contract actions and litigation involving claims of securities violations
  • defending a homeowners insurance company in various putative class actions asserting causes of action that challenged the carrier's method of determining the actual cash value (ACV) of damaged property
  • counseling more than a dozen financial institutions in a variety of matters, including loan enforcement and guaranty actions, lien disputes, litigation involving claims of wrongful foreclosure, putative class actions alleging violations of the Telephone Consumer Protection Act (TCPA) and Fair Debt Collection Practices Act (FDCPA) and post-judgment collection proceedings
  • advising mortgage servicers in defense of various claims arising out of federal law, including the Fair Credit Reporting Act (FCRA), Real Estate Settlement Procedures Act (RESPA) and Truth in Lending Act (TILA)
  • representing banks and insurance companies to recover damages related to violations of non-competition and non-disclosure agreements, as well as tortious interference with contracts and prospective business relations
  • obtaining positive results for clients in employment-related disputes, including Family and Medical Leave Act (FMLA) actions, Americans with Disabilities Act (ADA) lawsuits, harassment claims and U.S. Equal Employment Opportunity Commission (EEOC) investigations
