Overview

Steven Levitt represents secured and unsecured creditors, unsecured creditors’ committees, debtors, Chapter 11 trustees, Chapter 7 trustees, potential purchasers of distressed assets, and potential DIP lenders in complex corporate reorganizations and bankruptcy litigation. Mr. Levitt engagements have ranged across a wide array of industries, including energy, life insurance, healthcare, construction, manufacturing, and real estate. Mr. Levitt has represented or advised upstream and midstream oil and gas companies and counterparties, energy lenders, and private equity groups that specialize in distressed energy acquisitions.

Representative Experience

  • Represented the Official Unsecured Creditors Committee in In re Endeavour Operating Corporation, Case No. Case No. 14–12308 (KJC), U.S. Bankruptcy Court for the District of Delaware, which involves an upstream energy producer with greater than $1 billion of liabilities
  • Represented the debtors, oil and gas businesses engaged in acquiring, owning, developing and operating long-life oil and natural gas properties in Texas and Oklahoma with over $100 million in debt, in In re Parallel Energy LP, Case No. 15-12263 (KG), U.S. Bankruptcy Court for the District of Delaware
  • Represented the working interest owner in the bankruptcy case of an offshore Gulf of Mexico oil & gas E&P company  in In re Black Elk Energy Offshore Operations, LLC, Case No. 15-34287, U.S. Bankruptcy Court for the Southern District of Texas, Houston Division
  • Represented the Chapter 11 Trustee of a life insurance settlement company with expected life insurance maturities worth over $2 billion in In re Life Partners Holdings, Inc., Case No. 15-40289-RFN-11, U.S. Bankruptcy Court for the Northern District of Texas, Fort Worth Division
  • Represented the overriding royalty interest owners in the bankruptcy case of an offshore Gulf of Mexico upstream company in In re ATP Oil & Gas Corporation, Case No. 12-36186, U.S. Bankruptcy Court for the Southern District of Texas, Houston Division
  • Represented the debtor as tax counsel in In re Energy Future Holdings Corp., Case No. 14-10979 (CSS), U.S. Bankruptcy Court for the District of Delaware
  • Represented a fund manager and other employee creditors in In re Lehman Brothers Holdings, Inc., Case No. 08-13555, U.S. Bankruptcy Court for the Southern District of New York
  • Advised a midstream oil and gas company on oil and gas counterparty risk
  • Advised an upstream oil and gas company on the perfection of oil and gas liens
