Overview

Kelly McNeill is an attorney in Holland & Knight's New York office and member of the Litigation and Dispute Resolution Practice Group. Ms. McNeill represents clients in litigation matters across various industries and issues, including product liability, mass tort, aviation, data privacy, intellectual property and breach of contract matters.

Ms. McNeill has experience representing clients in complex disputes in federal and state courts, including appellate practice as well as alternative dispute resolution settings. She has experience with all aspects of the discovery process, including depositions, managing e-discovery and discovery motion practice. She is also well versed in drafting and arguing dispositive motions and all aspects of pre-trial preparation, including preparation of Daubert motions, motions in limine and jury instructions.

Ms. McNeill's representative matters include:

  • secured reversal of grant of summary judgment concerning insurance coverage via successful argument on motion to reconsider
  • successful exclusion of expert evidence in the representation of a medical device company in a bellwether trial for large multidistrict litigation
  • secured dismissal of putative class action alleging violations of the Video Privacy Protection Act (VPPA)
  • successful procurement of a preliminary injunction for a pharmaceutical company against one of its suppliers
  • secured dismissal of various breach of contract and personal injury claims against airlines on preemption grounds under the Airline Deregulation Act, the Federal Aviation Act and accompanying regulations, and international treaties, including the Montreal Convention
  • member of a team coordinating discovery, defense and ultimately securing dismissal of claims for generic pharmaceutical defendants in one of the largest federal multidistrict litigations in the country
  • defense of entities in various trademark disputes concerning infringement and cancellation of trademarks
  • member of a trial team representing a commercial insurance broker in a dispute involving claims of negligent procurement, fraud and breach of fiduciary duty

Ms. McNeill is committed to pro bono work, including representation of active U.S. military members, advocating for better mental health services in prisons, and working with a national policy and training organization to ensure better outcomes for youth interacting with law enforcement.

During law school, Ms. McNeill interned in the Litigation Bureau of the New York State Attorney General's office, served as a staff member for the Fordham Urban Law Journal, and worked as a teaching assistant for the first-year legal writing program. Prior to law school, Ms. McNeill worked as a care coordinator for a cancer center in New Jersey, where she helped ensure patient access to medical services.
