Overview
Courtney Miller is an attorney in Holland & Knight's Richmond office who helps lawyers, law firms and legal industry clients navigate complex professional responsibility, risk management and regulatory issues. Ms. Miller advises on matters at the intersection of legal ethics, business operations and litigation, with experience spanning legal services transactions, attorney discipline, professional responsibility and related disputes.
Ms. Miller represents lawyers and law firms in attorney discipline matters and related civil litigation, including proceedings before bar committees and in disciplinary proceedings, state and federal trial and appellate courts, and immigration court. Clients also turn to her for guidance on legal ethics questions involving bar complaints, alleged misconduct, criminal conduct, fee disputes, partner transitions, unauthorized practice of law, bar admissions and the use of generative artificial intelligence (AI).
Ms. Miller brings practical litigation judgment to each engagement, advising clients from pretrial strategy through appeal. She also has a focused background in religious liberty and separation of church and state issues, including publishing a law review article and filing an amicus brief on the topic.
In addition to her legal practice, Ms. Miller serves as adjunct faculty at Georgetown University Law Center, where she teaches professional responsibility courses to law students.
Prior to joining Holland & Knight, Ms. Miller was an attorney at a boutique law firm in its Washington, D.C., office. Earlier in her career, she clerked for the Honorable Catharine F. Easterly of the D.C. Court of Appeals and served as a law and policy fellow at an LGBTQ advocacy nonprofit organization.
While in law school, Ms. Miller was an editorial board member of the Virginia Law Review and managing board member of the Virginia Journal of Social Policy and the Law.
Representative Experience
- Obtained dismissals of bar complaints alleging a wide array of disciplinary infractions
- Navigated unauthorized practice of law inquiries by the Unlicensed Practice of Law (UPL) Committee and Committee on Admissions to successful agreements
- Secured voluntary dismissal of years-long civil litigation based on a client's former employer's allegations of UPL and other misconduct
- Filed an amicus brief discussing the constitutional meaning of religion and asking the U.S. Court of Appeals for the Fifth Circuit to reject the district court's theism (or "belief in God") requirement
- Filed an amicus brief arguing that a religious employer's denial of health benefits to a gay employee's same-sex spouse was discrimination based on sexual orientation
- Successfully defended a video-sharing platform on appeal by obtaining a ruling that barred the appellant's defamation and negligence claims
- Secured dismissals with prejudice of charges against several defendants in the "J20 Inauguration Day" protest cases coinciding with the 2017 U.S. presidential inauguration
- Obtained dismissal of baseless child abuse allegations by successfully moving for judgment as a matter of law after the Department of Social Services presented its case
