Overview

Andrew Tuggle is a trade attorney based in Huntsville and Birmingham. Mr. Tuggle focuses his practice on export controls, foreign investment and government contracting.

Mr. Tuggle helps clients navigate the Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR) and foreign direct investment guidelines, including those pertaining to the Committee on Foreign Investment in the United States (CFIUS), U.S. Department of Commerce's Bureau of Economic Analysis and the Agricultural Foreign Investment Disclosure Act. In addition, Mr. Tuggle advises on domestic preference requirements, such as the Buy America Act and Build America, Buy America Act, and if a violation occurs, he helps clients plan for investigation, mitigation and voluntary disclosure.

Prior to joining Holland & Knight, Mr. Tuggle was an attorney at a boutique law firm in its Huntsville office. Before law school, he worked for a large multinational hardware manufacturer, a small engineering-design startup and in academic research funded by the Defense Advanced Research Projects (DARPA) and the Group of Eight (G8) Industrialized Nations. His engineering research and development experience includes magnetic devices and materials, nanoscale electronics, computer modeling and simulation, and sensors.

Representative Experience

  • Secured a no-action letter from the U.S. Department of State's Directorate of Defense Trade Controls (DDTC) on a voluntary disclosure of violations, despite penalties potentially totaling $40 million
  • Secured Committee on Foreign Investment in the United States (CFIUS) approval of acquisition by a South Korean group of U.S. defense contractors valued at $20 million
  • Advised on trade compliance for the sale of a global property, plant and equipment business for $1.325 billion
  • Advised on trade compliance in the $4.95 billion acquisition of a global security and access solutions business
  • Negotiated a global distribution agreement for industrial machines valued at approximately $10 million per year
