Overview

Andrew H. "Andy" Weinstein advises domestic and international ultra-high-net-worth individuals on personal planning, asset protection, tax compliance and high-stakes global affairs, helping them protect private wealth and resolve tax matters before they escalate. Based in Miami, he draws on years of experience within the IRS, in criminal tax enforcement and civil tax disputes, and in private practice so individuals, companies, trusts and estates build planning that withstands governmental review at every level.

Asset protection is often an integral part of private client service, and Andy's approach emphasizes real-time, effective planning. For U.S. clients, he relies on proven domestic structures that are fully consistent with applicable state and federal statutes and court decisions and that preserve the client's complete control of private wealth. For non-U.S. clients, he considers both international and domestic structures. Clients describe his work as creative, cutting edge, responsive and ahead of changes in law, technology and client needs.

Andy's government background shapes both his planning and his advocacy. At the IRS, he was responsible for substantive examinations, collection proceedings, administrative appeals and tax litigation. He now applies that perspective to international, federal, state and local tax planning and compliance, maintaining strong relationships with government representatives as well as long-standing working relationships with foreign counsel to ensure cross-border representation is compliant and effective.

When matters involve government review, Andy guides clients through scrutiny of financial statements, tax returns and other mandated submissions, sensitive tax examinations, enforcement and collections, complex administrative appeals and tax litigation. He plans to avoid, resist and resolve taxes and major penalties, whether civil or criminal, and works with colleagues to efficiently handle highly complex situations.

Penalty matters are a significant part of his practice. Many Internal Revenue Code penalties must be paid before a taxpayer has a full opportunity to be heard by an independent judiciary, and international tax and financial reporting penalties can carry major financial consequences. Accountants and clients call on Andy to prevent compliance problems from the outset, during complex examinations and after penalties are asserted, and he has achieved significant success in penalty avoidance, reduction and abatement.

Whether issues are domestic, multistate or cross-border, Andy emphasizes early-stage, cost-efficient resolution. He also serves low-income taxpayers and counsels on veterans' affairs on a pro bono basis, and has served as an adjunct professor of law. His global perspective helps clients plan with confidence and resolve sensitive tax challenges on their terms.

Andy is board certified in tax law, a Fellow of the American College of Tax Counsel and the American College of Trust & Estate Counsel, listed in Chambers as a Senior Statesperson, Best Lawyers in America since 1989 and Lawyer of the Year in Litigation & Controversy – Tax, AV Preeminent Peer Reviewed in Martindale Hubbell, Lawdragon 500 Leading Global Tax Lawyers, Legal Week Private Client Global Elite and Florida Super Lawyers, among others.
