Healthcare and privacy attorney Beth Pitman will present on a BARBRI webinar examining the U.S. Department of Health and Human Services (HHS) Office for Civil Rights' (OCR) new civil enforcement program for noncompliance with 42 C.F.R. Part 2, which governs the confidentiality of substance use disorder (SUD) treatment records, and requirements of the 2024 Final Rule. The session will address what covered entities can expect during newly authorized civil investigations, including potential civil monetary penalties and corrective action plans, in addition to highlighting OCR's latest guidance and compliance tools, such as updated model notices under the Health Insurance Portability and Accountability Act (HIPAA), a model Part 2 patient notice, complaint procedures and breach reporting guides. Ms. Pitman also will also discuss practical best practices for Part 2 compliance as OCR begins enforcing these requirements in a manner more closely aligned with HIPAA.
