The Future of Corporate Criminal Pleas under Rules 11(c)(1)(C)

Recently, some federal district court judges have rejected pleas to federal crimes under the Federal Rule of Criminal Procedure 11(c)(1)(C), demonstrating a growing tension between a corporation's desire to resolve government investigations and the federal judges desire to expand their role in sentencing. This article examines Federal Rule of Criminal Procedure 11(c)(1)(C) and this apparent tension within the corporate scope.
