Defining Aggregate Settlements: The Road Not to Take

Fifty years after the American Bar Association created the first ethics rule governing "aggregate settlements," the rule's empirical meaning remains indefinable, both for practitioners and for the courts. Technically, the term is not defined in the rule and remains insufficient and internally erratic.
