As institutions start to use Automated Clearing House transfers for same-day delivery of funds, Article 4A of the Uniform Commercial Code will likely receive increased attention, and it may be a determining factor in whether or not ACH transfers expand into the role currently filled by wire transfers.

As Waller's Alex Buchanan explains, "If same-day delivery of ACH transfers becomes more of the norm, one of the historical safeguards of the ACH system will be eliminated, namely the delayed delivery of good funds, which allowed many financial institutions time to correct erroneous transfers."
